Buyers who arrive expecting Texas square footage at a Westchester address spend months frustrated. Buyers who reset the expectation before touring find something they love in a reasonable timeframe.

The Transaction Works Differently

Texas is a title company state. New York is an attorney state. The mechanics are genuinely different and the differences catch people.

  • You need a real estate attorney. Both buyer and seller retain attorneys in New York. Your attorney drafts or reviews the contract, holds the deposit, handles title work and takes you through closing. Retain one before you start touring.
  • An accepted offer binds nobody. In Texas a signed purchase agreement creates immediate obligations. In New York, either side can walk away until contracts are fully executed. Do not stop looking until contracts are signed.
  • Attorney review takes 7 to 10 days. That gap between accepted offer and signed contract is where Texas buyers most often lose houses to a higher offer.
  • The deposit is much larger. Contract deposits typically run 5 to 20 percent, delivered at contract signing, not the modest earnest money Texas buyers are used to.
  • Mortgage commitment in 30 to 45 days, with the whole process running roughly 60 to 90 days from accepted offer to closing.
  • Prices are public. Texas is a non-disclosure state. New York sale prices are recorded and public, which changes how you and the seller both negotiate.

The Detail That Costs Texas Buyers Houses

The 7 to 10 day attorney review window is the vulnerable period. Your offer was accepted, you feel finished, and legally nothing has happened yet.
